In addition to the website terms and conditions governing access to and use of www.backexperts.co.uk, access to and use of [The Back Experts] Community Forum (including both the 'Comments' to articles and 'Discussion Forum' functions) (the "Forum") is provided by Pfizer Consumer Healthcare Limited ("PCH") subject to the following terms and conditions :

1.    By accessing the Forum you acknowledge that you have read, understood and agree to the Forum Terms of Use. PCH may alter the Forum Terms of Use from time to time so you should periodically check these as any changes will take effect as soon as they are posted to this website. Your continued accessing of the Forum will be deemed acceptance of any updated or amended terms. If you do not agree to these Forum Terms of Use do not access, use or contribute to this site.

2.    The majority of the content posted in the Forum is created by Forum members. The views and opinions expressed are those of Forum members and unless specifically stated are not those of PCH. PCH is not responsible for any content posted by members.

3.    You agree to only use this Forum for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of this Forum. You must not use the Forum for any criminal, illegal or unauthorised purpose. In accessing and contributing to the Forum you agree to be bound by the following rules.

Your contributions to the Forum:

(a)    are lawful, tasteful, constructive and polite
(b)    do not infringe any UK laws
(c)    are not indecent, offensive, defamatory, obscene or abusive. In particular your contributions must not make any offensive comments that are connected to race, religion, social class, ethnicity, national origin, gender, sexual orientation or disability
(d)    are not intimidating, threatening, harassing, bullying, mocking or of such nature so as to cause upset, distress or inconvenience to any person, or posted with the intention of upsetting others
(e)    are not misleading
(f)    do not endanger yourself or others
(g)    do not contain any illegal content, including but not limited to content committing or promoting an illegal act
(h)    do not constitute spamming
(i)    do not knowingly cause the transmission of any viruses, bugs, worms or any other computer software code of a destructive nature or adverse effect
(j)    are not advertising or promotional
(k)    do not contain off-topic material
(l)    do not contain languages other than English
(m)    do not include profanity or any obscene, indecent, pornographic, sexual or otherwise objectionable content or language
(n)    do not contain links or references to websites which contain material of the type prohibited from inclusion in the Forum by these Forum Terms of Use
(o)    are your own original work and do not infringe the rights of any third party
(p)    do not include (i) images of nude adults; (ii) images of children under the age of 18 years; (iii) images showing illegal or dangerous activity or material; and/or (iv) images that a reasonable individual might find offensive, indecent and/or otherwise objectionable
(q)    where permitted images have been uploaded, the express permission of any individual identifiable in the image must be obtained prior to the image being uploaded    
(r)    do not reveal any personal information about yourself or anyone else (including but not limited to full name, address, telephone number, email address or any other information from which you can be personally identified)
(s)    are only uploaded in one area of the Forum

Any contribution which references medical and/or healthcare information should not be acted upon in the absence of, and is not a substitute for, advice provided by a doctor or other qualified healthcare professional. Always consult with a doctor or qualified healthcare professional.

You agree to PCH contacting you by e-mail for administrative or verification purposes in relation to your contribution.

4.    Where members post links or references to other websites maintained by third parties over whom PCH has no control, PCH is not responsible for any content of any third party websites. Any links to third party websites from the Forum do not amount to any endorsement of that website by PCH and any use of that website by you is at your own risk.

5.    The posting of content to the Forum is restricted to registered members only. Membership is restricted to residents of the UK who are aged 18 years or older, who have registered at www.backexperts.co.uk with a valid personal email address that is regularly accessed so that moderation emails can be sent. PCH reserves the right to close accounts in its absolute discretion.

6.    Your Forum member details are personal to you. You agree not to allow others to access the Forum using your access details. In addition, you agree not to create any additional accounts for the purpose of abusing the functionality of the site, other users, seeking to pass yourself off as another user or undertaking any activity in breach of these Forum Terms of Use.

7.    PCH may, without prior notice, suspend or terminate a registered member's account at any time if, in its absolute discretion, it considers the member to be in breach of any of these Forum Terms of Use and may, in its absolute discretion, decline any person access to and use of the Forum.

8.    If you reasonably consider that any contribution breaches these Forum Terms of Use, you must notify us immediately by contacting : admin@backexperts.co.uk with the following information:

(a)    your contact details, including name, address, telephone number and e-mail address;
(b)    a description of the contribution you believe to be in breach and sufficient information to permit PCH to locate the contribution; and
(c)    a brief statement as to why you believe the contribution to be in breach.

9.    PCH reserve the right (but assume no obligation), at its sole discretion and convenience, to edit or delete content that it considers unacceptable or inappropriate, or for any other reasons, which PCH need not disclose, without notice. PCH's decision is final.

10.    By submitting contributions to the Forum (including but not limited to text, images, photographs, video and audio) you agree to grant to PCH an irrevocable, non-exclusive, perpetual, royalty-free, worldwide licence to use the content of your contributions in any format for any purpose, including but not limited to marketing and promotional purposes. This includes a right to modify, edit, crop, highlight ad/or republish the content of your contributions.

11.    You can deregister from the Forum and remove your profile and/or contributions from the Forum at any time by contacting admin@backexperts.co.uk with your name, user name and email address telling us that you would like to de-register. To remove a contribution please provide details of the contribution that you wish to remove together with your name, user name and email address.

12.    PCH does not warrant that the use of this service will be uninterrupted, error free or free of any viruses, bugs or anything which may have destructive properties. In accessing and using the Forum you agree that it is your responsibility to take and implement sufficient precautions in this respect.

13.    PCH respects the privacy of the Forum users. Please refer to our Privacy Policy which explains users' rights and the basis on which PCH may use any personal data (including by using "cookies") that is disclosed to PCH via this website.

14.    PCH reserves the right to amend, modify, suspend or terminate the Forum for any reason, without notice at any time.

15.    To the extent that any provisions of these Forum Terms of Use are held to be illegal, invalid or unenforceable, then such provisions shall be severed and deleted without affecting the enforceability of the remaining provisions.

16.    The Forum and its contents are intended to comply with English laws and is only intended for use by UK residents. These Forum Terms of use and your use of the Forum shall be governed by and construed in accordance with the laws of England. The English courts shall have exclusive jurisdiction over any disputes arising out of or in connection with the Forum.
